Terms of Service
Effective date: November 4, 2026
Version 1
Short version
A summary first. The numbered sections are the agreement, and they control if this summary reads differently.
- bmiapi is an independent tool. It is not affiliated with, endorsed by or operated by BMI.
- Answers come from BMI's public Songview pages. They can be incomplete, out of date or wrong. Confirm with the rights holder or BMI before you rely on one.
- We do not own Songview data, and we give you no license to it. If you store, publish, share or build on answers, you are responsible for any permission that BMI or a rights holder requires.
- You are responsible for your account, your API keys, and anything your scripts, apps or AI agents do with them.
- Paid plans renew until you cancel. You can cancel at any time in the Stripe billing portal, and your plan runs to the end of the period you paid for.
- bmiapi is provided as is. Sections 14 and 15 limit warranties and our liability.
1. Who we are and how you agree
bmiapi.com, the bmiapi API and the bmiapi MCP server (together, "bmiapi" or "the service") are run by Yung Recs.
In these Terms, "we", "us" and "our" mean Yung Recs. Section 21 has our contact details.
These Terms are an agreement between you and us. The current version is at https://bmiapi.com/terms, with its effective date at the top.
How you agree. When you create an account, you accept these Terms, and confirm that you have read the Privacy Notice, by checking the agreement box and selecting "Create account". When you buy a paid plan, you accept these Terms again by checking the agreement box shown before you complete checkout. These Terms also apply to any other use of bmiapi, such as signed-out searches. If you do not agree, do not use the service.
Age. You must be at least 18 years old, or the age of majority where you live if that is higher. You confirm that you are at least 18 when you create an account.
Organizations. If you use bmiapi for a company or other organization, you accept these Terms for that organization and confirm that you have the authority to do so. "You" then means both you and the organization.
Separate agreements. If you have a separate signed agreement with us, such as an Enterprise agreement, that agreement controls where it conflicts with these Terms.
2. What bmiapi is
bmiapi looks up public repertoire data on BMI's Songview search and returns it as structured answers: works, writers, publishers, performers, identifiers, society shares, and the publisher contacts that Songview lists.
Independent service. bmiapi is not affiliated with, endorsed by, sponsored by or operated by Broadcast Music, Inc. ("BMI"), ASCAP, any other performing rights organization, or any Songview partner. Nothing on bmiapi is an official BMI product, record or statement.
Accuracy. Every answer comes from a Songview page as it was when we read it. Saved answers show when we pulled them from Songview. A live answer is returned when the lookup completes; it may not include a separate pull date. Songview may omit information relevant to your question, and its data may be incomplete, out of date or wrong. The registry can change after we save an answer, and our reading of a page can contain mistakes. BMI says that it "cannot give a blanket guarantee regarding the accuracy of the data". We do not guarantee bmiapi answers either.
Verify before you rely. Before you use an answer for licensing, clearances, royalty claims or payments, legal filings, or any other decision that matters, confirm it with the rights holder, with BMI, or on the Songview page itself. BMI makes some assurances to people who rely on Songview. Those assurances come from BMI, on BMI's terms, and may not cover data you got through bmiapi.
Not advice. bmiapi does not give legal, licensing, tax or financial advice. A share is a society-level percentage as BMI lists it. It is not a per-person split, and it does not say who owns a work.
Corrections. We do not edit registry data. If a Songview listing is wrong, the correction must be made with BMI or the relevant society. bmiapi may continue to show a saved answer until it expires or we store a newer answer.
3. BMI and Songview data
bmiapi gives you access to answers that it reads from Songview. We do not own Songview data, and these Terms grant you no license to it.
BMI says that "BMI and/or its Songview partner(s) own all rights in the data platform", and that the platform "is intended for research and information purposes in the form presented". BMI restricts copying and reuse of the platform without its written permission. BMI's terms govern Songview data, including data you get through bmiapi.
If you store, publish, share or build on answers, you are responsible for having any permission that BMI or a rights holder requires.
4. Accounts and API keys
- Give us an email address that you control, and keep it current. We send account, security and billing notices to it.
- An account sign-in belongs to one person. Do not share your password.
- An organization may authorize its teammates and systems to use its API keys for the organization's work. The organization is responsible for that use.
- Keep your password and API keys secret. Do not put keys in public code, in shared prompts, or in code that runs in a browser.
- You are responsible for all activity under your account and keys until you revoke the key on the Keys page or tell us that it is compromised. If you think someone else is using your account or a key, revoke the key and email us promptly.
- API keys are available after you verify your email. Each account can have up to the number of active keys that the pricing page states, currently five.
5. Acceptable use
Use bmiapi only for lawful purposes and only as these Terms allow. You must not do any of the following, or help or allow anyone else to do them:
- Scrape, crawl or bulk-copy bmiapi (the website, API or MCP server) to build or feed a database, dataset or service that competes with bmiapi or replaces it.
- Get around limits, quotas or access controls. Examples: opening extra accounts, cycling through keys, networks or IP addresses to get more allowance, pooling keys across unrelated users, or gaming the invite program. Replacing a key for security reasons is fine.
- Use bmiapi to disrupt, overload, probe or harm Songview or any other BMI system, or try to make bmiapi send BMI more requests than its own limits allow.
- Sell, resell, rent or sublicense bmiapi, or give others raw access to it or to its answers, such as through a proxy API or a bulk data feed, without our written permission. You may build your own products on bmiapi for your own users, as long as your product does not resell bmiapi or give raw access to it or its answers, and you follow section 3.
- Use bmiapi in a way that breaks the law or infringes anyone's rights, including privacy, data protection, anti-spam and intellectual property laws.
- Use writer or publisher contact details for spam, bulk unsolicited marketing or harassment. Use them only for relevant rights and licensing inquiries.
- Present bmiapi answers as official BMI data, or suggest that BMI or any society endorses you or your product.
- Probe, scan or test the security of bmiapi, break into accounts or systems, access other people's data, or send malware or other harmful code, unless we agree to it in writing.
- Interfere with the service or with other users, or copy, modify or reverse engineer bmiapi's software, except for the code samples in our docs (section 11) or where the law allows it.
You are responsible for making sure that your use of data you get through bmiapi follows the law and any terms or rights that apply to it, including the terms of the services you connect to bmiapi. Section 3 covers Songview data.
6. Limits, live lookups and saved answers
A live lookup asks BMI now. A saved answer is an answer that bmiapi already has and returns without asking BMI again. Saved answers show when we pulled them from Songview; a live answer may not include a separate pull date. Live lookups use your plan's daily allowance. Saved answers do not use the allowance, but they have per-minute rate limits. The current allowances are on the pricing page, and the current rate limits are in the docs. The daily allowance resets at 00:00 UTC, and unused allowance does not carry over. Signed-out searches share a small daily allowance across all signed-out visitors.
BMI's site can take only a small number of requests, and bmiapi shares that capacity across everyone. To manage that capacity, protect BMI's site or stop abuse, we may, without notice:
- queue a live lookup and answer it later, for example with HTTP 202 and a time to check back;
- return a saved answer instead of a live one when live capacity is full;
- slow down, limit or refuse requests, for example with HTTP 429.
A paid plan gives you a larger allowance and priority in the queue. It does not guarantee a speed, a number of completed lookups, or that BMI will answer. As the pricing page explains, a live lookup that fails does not use your allowance.
The answer to a live lookup is saved. We may return it to other callers whose request matches the same normalized search, or whose request a saved page of results already covers. A saved answer contains Songview data. It does not contain your lists or your account details.
We may change limits, allowances and how saved answers work. When we do, we update the pricing page and the docs. Section 17 covers changes during a period you have paid for.
7. Plans, billing, renewal, cancellation and refunds
Plans. The Free plan costs nothing. The pricing page lists the paid plans and their prices. Some plans, such as Label, have limited availability, and we may decline an order. Enterprise terms need a separate signed agreement.
Features. Paid plans may include the features shown on the pricing page. Features, limits and availability may change under section 17. No response time, export format or support level is promised unless a separate signed agreement says so.
Promotional terms. The Free plan and the invite rewards are current promotional terms. They are not a promise that pricing or the invite program will stay the same. Any change follows section 17 and applies only from then on.
Checkout. Before you complete checkout, the checkout page shows the plan, the total price, the billing interval, that the plan renews automatically, how to cancel, and any tax charged.
Payment. Stripe processes our payments, and we do not receive or store your full card number. When you subscribe, you authorize us, through Stripe, to charge your payment method for each billing period. Prices do not include taxes unless the checkout page says so, and you are responsible for any taxes that apply. A promotion code is subject to the terms shown with that code.
Renewal. Paid plans are billed in advance, monthly or yearly. They renew automatically at the end of each period, at the price then in effect, until you cancel. If we change the price of your plan, we tell you at least 30 days before the new price applies to your next renewal, so that you can cancel first.
Cancellation. You can cancel at any time in the Stripe billing portal, which opens from Billing in your dashboard. Cancellation stops the next renewal. You keep your paid plan until the end of the period you paid for, and then your account moves to Free. Your account, keys and lists stay.
Plan changes. Upgrades, downgrades and changes between monthly and yearly billing happen in Stripe checkout or the billing portal. Any proration or credit is what Stripe shows you when you make the change.
Failed payments. If a payment fails, Stripe may try it again. If the payment stays unpaid, we may move your account to Free or suspend paid features.
Refunds. Amounts paid are non-refundable, including for partly used periods and unused allowance, unless the law, this section (for a renewal charged after you asked us to delete your account), section 13, section 17, or the checkout or order page provides for a refund. We may also choose to give a refund. If you think we charged you in error, email us.
Deleting your account. When you ask us to delete your account, we first delete your customer record at Stripe. That normally cancels any active subscription at once, and the refund rule above applies to the rest of the period. If the Stripe step fails, your account stays as it is, and we retry. If a renewal is charged after you asked us to delete your account, we refund it. To keep the time you paid for, cancel in the billing portal first, and delete the account after the period ends.
8. Invites and bonus lookups
You can invite people with your invite link. When a person you invited verifies their email and makes a first live lookup, your account gets the bonus lookups that the site describes. The invite rules on the site also apply. These include one reward for each invited person, a rule that the invited person must sign up from a different network than yours, and a monthly cap.
Bonus lookups are a promotional credit. They have no cash value, and you cannot sell them, transfer them or exchange them for money. They are used after your plan's daily allowance, up to the daily bonus limit, and the same limits apply to them as to other live lookups. Bonus lookups you have earned do not expire while your account stays open. They end when the account is deleted or closed.
We may refuse or remove rewards that come from self-invites, fake or duplicate accounts, spam, or other abuse. Send your link only to people who would want it, and do not share it in ways that break the law or another site's rules. We may change or end the invite program for future invites.
9. AI agents, apps and MCP connectors
You can connect AI apps such as Claude or Grok, or your own tools, to bmiapi by signing in through OAuth or by sending an API key. Signing in through OAuth creates a named API key on your account, which counts toward your key limit. The app's lookups use your allowance and limits like any other request.
Disconnecting. You can disconnect an app on the Connect page or revoke its key at any time. A revocation usually takes effect within seconds, but it can take a few minutes to reach every server. Requests that arrive in that time may still complete.
You are responsible for everything that an app, agent or script does with your account or keys, including requests it makes without asking you first.
An AI app can misread an answer, summarize it wrongly, mix it with other information, or add details that are not in the bmiapi answer. Check the bmiapi answer or the Songview page before you rely on what an AI app tells you.
Other companies run Claude, Grok and other apps under their own terms and privacy policies, and we do not control them. What you share with them is between you and them, including text you copy with "Copy for Claude" and files you export.
10. Your content
Your content means the lists you save, their names and rows (such as titles, writer names, ISWCs and BMI Work IDs), and the search text you send.
You keep the rights you have in your content. This does not give you rights in Songview data or other third-party material, even when it appears in your lists.
You give us a non-exclusive, worldwide, royalty-free license to host, store, copy, process and display the parts of your content needed to run, secure and support bmiapi. This license ends when the content is deleted, except for copies in backups and records that the law requires us to keep. Those last until their retention periods end.
You confirm that you have the right to submit your content and that it does not break the law or anyone's rights. Do not put passwords, payment details or other sensitive personal information in lists or searches.
If you send us feedback or ideas, we may use them without any obligation to you.
11. Intellectual property
We own the bmiapi software, website, documentation and API design. This does not include Songview data or material that belongs to others.
Under these Terms, we give you a limited, non-exclusive and revocable right to use bmiapi. We can revoke it only as section 13 allows. You may not transfer this right, except that an organization may let its teammates and systems use its keys as section 4 allows. You may copy and adapt the code samples in our docs to use with bmiapi.
Section 3 covers Songview data.
BMI®, Broadcast Music, Inc.®, Songview, ASCAP, Claude, Grok, Stripe, and other names and marks belong to their owners. We use them only to describe what bmiapi works with.
12. Privacy
Our Privacy Notice at https://bmiapi.com/privacy describes what data we keep, how long we keep it, and how account deletion works. It is a separate notice, not part of these Terms. The law, or a provider's own record-keeping duties, can require some records to be kept longer. You can ask us to delete your account in Account or by email.
13. Suspension and termination
By you. You can stop using bmiapi at any time. You can delete your account in Account or by emailing us. Section 7 explains what happens to a paid plan.
Suspension. We may suspend or limit your access, keys or connectors only as far as is reasonably necessary for security, to stop abuse, for nonpayment, to comply with the law, or to protect the service, its users or Songview. When it is reasonably practicable, we tell you first and give you a chance to fix the problem. We end a suspension once its reason no longer applies.
Termination for breach. We may close your account if you materially breach these Terms and do not fix the breach within a reasonable time after we tell you about it. We may close it without that chance if the breach is serious abuse, fraud or a threat to security, or if the law requires it.
Termination without cause. We may close an account for any other reason with at least 30 days' notice. We then refund the unused part of any prepaid period.
After termination. Your right to use bmiapi ends. We delete your data as the Privacy Notice describes, subject to backups, records that the law requires us to keep, and the other retention periods it states. Deleted lists and other content may not be recoverable, so keep your own copies. Any amount you owe stays due. Sections 2, 3, 7 (for amounts owed and refunds due), 10, 11, 14, 15, 16, 18, 19 and 20, and this paragraph, continue to apply after termination.
14. Warranty disclaimer
The status page reports how the service is doing. It is not a promise of availability.
15. Limitation of liability
16. Indemnity
You will defend, indemnify and hold harmless us and our officers, directors, employees and agents against any third-party claim, and against the judgments, settlements and reasonable legal fees that come from it, to the extent the claim is caused by:
- your content;
- your material breach of these Terms; or
- your unlawful use of bmiapi, or your use of an answer in a way that infringes another person's rights.
You are not responsible to the extent the claim was caused by our gross negligence, our willful misconduct or our breach of these Terms.
We will tell you promptly about the claim, let you control its defense, and give reasonable help at your cost. You may not settle a claim in a way that admits fault for us or places an obligation on us without our written consent. We may join the defense with our own lawyer at our own cost.
17. Changes to bmiapi and to these Terms
The service. We may add, change or remove features, limits and plans. Parts of bmiapi depend on Songview, so they may change or stop working if BMI changes, limits or blocks access to Songview, or if BMI launches its own official API. If we stop offering bmiapi altogether, we give at least 30 days' notice when we reasonably can, and we refund the unused part of any prepaid period. If we lower the allowance or limits of a paid plan, or remove one of its features, during a period you have paid for, we tell you first. If you cancel because of it, we refund the unused part of that period. This does not cover the temporary queueing and limits described in section 6.
These Terms. We may update these Terms by posting a new version at https://bmiapi.com/terms with a new effective date. We keep prior versions available there. A change takes effect only on its stated effective date. We give at least 14 days' notice of a material change by email or in your dashboard. A change needed for legal, security or abuse reasons can take effect sooner.
Paid periods. A material change does not apply to you before the end of your prepaid billing period, unless the law, security or abuse prevention requires it. If such a change applies during your prepaid period and you cancel because you do not accept it, we refund the unused part of that period.
If you do not accept a change. Stop using bmiapi, and cancel your plan or delete your account, before the change takes effect. If you keep using bmiapi after a change takes effect, the new version applies to you.
18. Governing law and disputes
The laws of the Commonwealth of Massachusetts, USA, govern these Terms and any dispute about them or about bmiapi, without regard to conflict-of-law rules.
Talk to us first. Before either of us files a claim, you and we try to resolve it informally. Whoever has the claim sends written notice, and then you and we try in good faith for 30 days to resolve it. You send notice by email to paul@bmiapi.com, with your name, your account email, a description of the problem and the outcome you want. We send notice to your account email. This step does not waive or extend any statute of limitations (the legal deadline to bring a claim). It does not stop either of us from filing a claim to preserve it, going to small claims court, asking a court for urgent relief, or bringing a claim that consumer law allows without this step.
Courts. If you and we cannot resolve the dispute, either of us may bring a claim only in the state or federal courts located in Suffolk County, Massachusetts, and you and we agree to the jurisdiction of those courts. A small claims case may be brought in any small claims court that has jurisdiction.
If you are a consumer and the law where you live gives you rights that a contract cannot waive, including the right to bring a claim in your local courts, these Terms do not take those rights away.
19. Export and sanctions
You may not use bmiapi if you are located in, or ordinarily resident in, a country or region subject to comprehensive US sanctions. You may not use bmiapi if you are on a US government list of restricted parties, or owned or controlled by a party on such a list. You must not use bmiapi in breach of US or other applicable export control or sanctions laws.
20. General terms
- These Terms, any order, and any separate signed agreement with us are the entire agreement between you and us about bmiapi. The Privacy Notice is a separate notice and is not part of these Terms unless it expressly says so.
- If a court finds that part of these Terms cannot be enforced, that part is enforced as far as the law allows, and the rest stays in effect.
- If we do not enforce a right at once, we have not waived it.
- You may not assign these Terms or your account without our written consent. We may assign them to a successor in a merger, sale or reorganization if the successor takes on our obligations under them.
- We are not responsible for delays or failures caused by events outside our reasonable control. These include outages at providers we rely on, and changes, limits or blocks at BMI or Songview.
- We may send you notices at your account email or show them in your dashboard. Send legal notices to us by email at paul@bmiapi.com. A postal address for legal notices is available on request.
- These Terms do not create a partnership, employment or agency relationship. Only you and we can enforce these Terms, except that the people named in section 16 can rely on that section.
- Headings and the short version at the top are for convenience only. "Including" means "including without limitation".
